Terms of service

TERMS OF SERVICE

Last updated: 26 August 2026

Welcome to Yound bursh.

These Terms of Service ("Terms") govern your access to and use of Youndbursh.store (the "Website") and any products, services, features or content made available through the Website.

Throughout these Terms, the terms "Yound bursh", "we", "us" and "our" refer to Yound bursh.

The terms "you", "your" and "customer" refer to any person accessing the Website or purchasing products from us.

By accessing our Website, creating an account, placing an order or otherwise using our services, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable Australian law.

1. ELIGIBILITY

By placing an order through our Website, you confirm that:

  • you have legal capacity to enter into the transaction;

  • the information you provide is accurate and complete;

  • you are authorised to use the payment method submitted with your order; and

  • you will comply with these Terms and all applicable laws.

If you are under 18 years of age, you should use the Website and make purchases only with the involvement and consent of a parent or legal guardian where required.

2. ONLINE STORE TERMS

You must not use our Website or products for any unlawful, fraudulent or prohibited purpose.

You must not:

  • violate any applicable law or regulation;

  • interfere with the security or operation of the Website;

  • attempt to gain unauthorised access to any system or account;

  • transmit malicious code, viruses or harmful software;

  • scrape or systematically extract Website content without authorisation where prohibited by law;

  • impersonate another person;

  • provide false or misleading information;

  • use another person's payment details without permission;

  • engage in fraudulent transactions; or

  • use the Website in a way that infringes another person's intellectual property or other legal rights.

We may restrict access to the Website where reasonably necessary to protect our customers, systems, rights or legitimate business interests.

3. PRODUCTS AND SERVICES

We aim to describe and display our products as accurately as reasonably possible.

Product descriptions may include information regarding:

  • colour;

  • size;

  • dimensions;

  • materials;

  • design;

  • specifications;

  • features; and

  • availability.

Colours and appearance may vary slightly depending on your device, screen settings, lighting and photography.

However, nothing in this section limits your rights where a product does not match its description or otherwise fails to comply with a consumer guarantee under the Australian Consumer Law.

We do not intend any Website disclaimer to permit products to materially differ from representations made to customers.

4. PRODUCT AVAILABILITY

All products are subject to availability.

Placing an item in your shopping cart does not reserve that product.

If a product becomes unavailable after you place an order, we will contact you as soon as reasonably practicable.

Where we cannot supply a product you have paid for, we will provide an appropriate remedy in accordance with applicable Australian law, which may include a refund.

We will not substitute a materially different product without your agreement.

5. PRICES

Unless otherwise clearly stated, prices displayed on the Website are in Australian dollars (AUD) for customers shopping through the Australian version of our Website.

Prices displayed to consumers will be presented in accordance with applicable Australian pricing laws.

Where required, the total price will include applicable taxes, duties and unavoidable or pre-selected charges that can be calculated at the time the price is displayed.

Delivery charges or other optional charges that depend on choices made during checkout will be disclosed before you complete your purchase.

We do not intend to engage in misleading drip pricing or conceal mandatory charges from customers.

6. PRICE CHANGES

Product prices may change from time to time.

A price change will not ordinarily affect an order that has already been validly accepted by us, except where permitted by law or agreed with you.

Promotions and discounts may be subject to separate terms disclosed at the time of the promotion.

Nothing in this section permits us to mislead customers about pricing or to avoid obligations arising under Australian law.

7. PRICING AND WEBSITE ERRORS

We make reasonable efforts to ensure prices, descriptions and other information displayed on the Website are accurate.

Occasionally, genuine typographical, technical or system errors may occur.

If we identify a material error affecting your order, we may contact you to explain the issue and, where legally permitted, offer an appropriate solution.

If an affected order cannot lawfully or reasonably be fulfilled and payment has already been taken, any refund to which you are entitled will be processed promptly.

Nothing in this section limits your rights under the Australian Consumer Law.

8. ORDERS

When you submit an order, you are requesting to purchase the selected products subject to these Terms.

After an order is submitted, you may receive an automated acknowledgement confirming that we have received your order.

An automated acknowledgement does not necessarily mean that the order has been finally accepted.

We may perform reasonable checks relating to:

  • product availability;

  • payment authorisation;

  • suspected fraud;

  • incorrect customer information; or

  • compliance with these Terms.

Where we decline or cancel an order, we will act consistently with applicable law and provide a refund of amounts paid where required.

9. ORDER ACCEPTANCE

A contract for the purchase of products is formed when your order is accepted by us in accordance with our checkout and order processing procedures.

Acceptance may be communicated through an order confirmation, dispatch confirmation or another clear communication depending on the circumstances.

Nothing in this section limits any rights or obligations that arise under applicable Australian contract or consumer law.

10. ORDER CANCELLATIONS

If you wish to cancel or change an order, contact us as soon as possible:

Email: costumer@Youndbursh.store

We will make reasonable efforts to accommodate cancellation or modification requests before dispatch.

However, we cannot guarantee that an order can be changed or cancelled once processing or fulfilment has begun.

Your statutory rights remain unaffected.

11. PAYMENT

Payment must be made using one of the payment methods offered during checkout.

Available payment methods may vary.

By submitting payment information, you represent that:

  • the information is accurate;

  • you are authorised to use the payment method; and

  • the payment may be processed for the amount disclosed at checkout.

Payments may be processed by third-party payment providers.

We do not guarantee approval of a transaction by your financial institution or payment provider.

12. PAYMENT SECURITY

We take reasonable measures to use reputable payment and technology providers.

Payment providers may process financial information under their own terms and privacy practices.

You are responsible for taking reasonable steps to protect your account credentials and payment information.

Please contact us promptly if you believe an unauthorised transaction relating to our Website has occurred.

13. RECEIPTS AND ORDER CONFIRMATIONS

We may provide order confirmations and receipts electronically.

Where Australian law requires us to provide a receipt or proof of transaction, we will do so.

Customers should retain their order confirmation and other purchase documentation as proof of purchase.

14. SHIPPING AND DELIVERY

Shipping is subject to our separate Shipping Policy, which forms part of these Terms.

Delivery estimates shown on our Website are estimates unless expressly stated otherwise.

Actual delivery may be affected by circumstances including:

  • carrier operations;

  • weather;

  • transport interruptions;

  • customs processing where applicable;

  • incorrect delivery information;

  • public holidays;

  • remote delivery locations; and

  • other circumstances outside our reasonable control.

We will not use this section to avoid obligations where goods have not been supplied within a period required by applicable law.

15. DELIVERY INFORMATION

You are responsible for providing complete and accurate delivery information.

Please carefully review:

  • recipient name;

  • delivery address;

  • postcode;

  • state or territory;

  • email address; and

  • other information requested during checkout.

If you discover an error, contact us promptly.

We will make reasonable efforts to correct delivery details before dispatch, but changes cannot always be guaranteed after fulfilment has begun.

16. RISK AND DELIVERY

Responsibility for loss or damage to products will be determined in accordance with applicable Australian law and the circumstances of delivery.

Nothing in these Terms is intended to transfer risk to a consumer in circumstances where doing so would be unlawful or unfair.

17. RETURNS, REFUNDS AND EXCHANGES

Returns, refunds and exchanges are governed by our Return & Refund Policy and the Australian Consumer Law.

Our voluntary return conditions operate in addition to your statutory rights.

Nothing in our Return & Refund Policy or these Terms excludes consumer guarantees that cannot legally be excluded.

18. AUSTRALIAN CONSUMER GUARANTEES

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, products supplied to consumers must:

  • be of acceptable quality;

  • be fit for their normal purpose;

  • be fit for a particular purpose made known to us where applicable;

  • match their description;

  • match any applicable sample or demonstration model; and

  • comply with applicable express warranties.

Consumer guarantees exist automatically and are separate from any voluntary warranty or return policy offered by Yound bursh.

19. FAULTY PRODUCTS

If a product is faulty, unsafe, materially different from its description or otherwise fails to comply with a consumer guarantee, you may have rights to a:

  • repair;

  • replacement;

  • refund;

  • cancellation; or

  • compensation,

depending on the nature and seriousness of the failure and the requirements of the Australian Consumer Law.

For a major failure, consumers may have the right to choose a refund or replacement where the law provides that choice.

Contact:

costumer@Youndbursh.store

20. CHANGE OF MIND

Australian Consumer Law does not generally require businesses to provide a refund simply because a customer changes their mind.

However, Yound bursh may provide voluntary change-of-mind returns under our Return & Refund Policy.

Where we offer such a policy, we will apply it in accordance with the conditions communicated to customers.

Statutory consumer rights relating to faulty or non-compliant products remain unaffected.

21. PROMOTIONS AND DISCOUNT CODES

From time to time, we may provide:

  • promotional codes;

  • discounts;

  • special offers;

  • bundle offers;

  • free gifts; or

  • limited promotions.

Additional conditions may apply and will be disclosed where relevant.

Unless otherwise stated:

  • offers cannot be exchanged for cash;

  • discount codes cannot be applied retrospectively;

  • promotions may have reasonable eligibility conditions; and

  • promotions may end on the stated expiry date or when allocated stock is exhausted.

Any advertising or representations concerning a promotion will be made subject to Australian consumer law.

22. GIFT ITEMS AND PROMOTIONAL PRODUCTS

Products provided as part of a promotion may be subject to reasonable promotional conditions.

Nothing in these Terms excludes any consumer guarantees that may apply to goods supplied as part of a transaction.

23. ACCOUNTS

Some Website features may allow you to create a customer account.

You are responsible for:

  • maintaining the confidentiality of your login information;

  • providing accurate information;

  • updating relevant account information; and

  • notifying us of suspected unauthorised access.

You must not intentionally allow another person to misuse your account.

We may take reasonable security steps if suspicious activity is detected.

24. REVIEWS AND USER CONTENT

Where the Website permits you to submit reviews, comments, photographs or other content, you must ensure that your content:

  • is based on genuine experience where represented as a customer review;

  • is not knowingly false or misleading;

  • does not infringe intellectual property rights;

  • does not contain unlawful threats or harassment;

  • does not contain malicious code; and

  • complies with applicable law.

We may moderate or remove content where reasonably necessary for legal, security or platform integrity reasons.

We will not manipulate reviews in a way that creates a false or misleading impression of customer experiences.

25. LICENCE FOR USER CONTENT

If you voluntarily submit content for publication on our Website, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes reasonably connected with operating and promoting our business.

This licence does not transfer ownership of your content to us.

We will not exercise this licence in a manner inconsistent with applicable law.

26. INTELLECTUAL PROPERTY

Unless otherwise stated, content made available through Youndbursh.store, including:

  • logos;

  • branding;

  • Website design;

  • graphics;

  • photographs;

  • text;

  • product presentation;

  • icons; and

  • other original content

is owned by, licensed to or lawfully used by Yound bursh and may be protected by applicable intellectual property laws.

You may access the Website for personal, non-commercial use.

You must not reproduce, distribute, modify or commercially exploit protected Website content without permission except where permitted by law.

27. THIRD-PARTY INTELLECTUAL PROPERTY

Trade marks, names, logos and other intellectual property belonging to third parties remain the property of their respective owners.

Nothing on our Website should be interpreted as granting rights in third-party intellectual property unless expressly stated.

28. THIRD-PARTY SERVICES

Our Website may rely on third-party providers for functions including:

  • Website hosting;

  • payment processing;

  • shipping;

  • analytics;

  • customer support;

  • marketing;

  • fraud prevention; and

  • other technical services.

These third parties may have separate terms and privacy practices.

We remain responsible for our obligations to consumers to the extent required by Australian law.

29. THIRD-PARTY LINKS

Our Website may contain links to third-party websites.

Links are provided for convenience and do not necessarily mean that we endorse or control those websites.

We are not responsible for third-party content or practices except to the extent responsibility cannot lawfully be excluded.

Customers should review the applicable terms and privacy policies of third-party websites before using them.

30. PRIVACY

Our collection, use, storage and disclosure of personal information is addressed in our Privacy Policy.

Where the Privacy Act 1988 (Cth) and Australian Privacy Principles apply to us, we will handle personal information in accordance with those requirements.

Using the Website does not constitute consent to practices for which Australian privacy law requires separate consent or another lawful basis.

31. ELECTRONIC COMMUNICATIONS

By providing your email address or other contact details in connection with an order, you agree that we may send communications reasonably necessary to:

  • process your order;

  • confirm payment;

  • provide delivery information;

  • provide customer support;

  • communicate changes affecting your transaction; and

  • fulfil legal obligations.

Marketing communications will be handled separately and subject to applicable Australian laws governing electronic marketing.

32. WEBSITE AVAILABILITY

We aim to maintain reliable access to the Website but do not guarantee uninterrupted or error-free operation.

The Website may occasionally be unavailable because of:

  • maintenance;

  • technical problems;

  • security issues;

  • hosting interruptions; or

  • circumstances outside our reasonable control.

We may make reasonable changes required to maintain, secure or improve the Website.

33. WEBSITE INFORMATION

We take reasonable care when preparing Website information.

However, Website content may occasionally contain typographical or technical errors.

Nothing in these Terms permits us to make false, misleading or deceptive representations about products, prices, availability or consumer rights.

34. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Yound bursh will not be liable for losses that:

  • were not reasonably foreseeable;

  • were not caused by our breach or conduct;

  • were caused by your unlawful or improper use of the Website; or

  • are excluded or limited by law.

However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable Australian legislation.

Where Australian law permits liability to be limited, any limitation will apply only to the extent permitted by law.

35. NO EXCLUSION OF STATUTORY RIGHTS

Any exclusion, disclaimer or limitation contained in these Terms is subject to mandatory Australian law.

If Australian law gives you rights that cannot be excluded by agreement, those rights prevail over any inconsistent provision of these Terms.

36. INDEMNITY

To the extent permitted by law, you are responsible for loss reasonably incurred by us as a direct result of your intentional unlawful conduct, fraud or material breach of these Terms.

You will not be required to indemnify us for losses caused by:

  • our own negligence;

  • our breach of these Terms;

  • our unlawful conduct; or

  • matters for which liability cannot lawfully be transferred to you.

This section is intended to operate only to the extent that it is fair and enforceable under applicable Australian law.

37. FRAUD AND SECURITY

We may take reasonable steps to prevent fraudulent or unauthorised transactions.

Where reasonable grounds exist, these steps may include:

  • requesting additional order verification;

  • delaying fulfilment while verification occurs;

  • rejecting fraudulent payment attempts; or

  • cancelling transactions reasonably believed to be fraudulent.

If a legitimate paid order is cancelled, we will provide any refund required by law.

38. SUSPENSION OR TERMINATION OF ACCESS

We may suspend or restrict Website access where reasonably necessary because of:

  • fraud;

  • unlawful activity;

  • serious or repeated breaches of these Terms;

  • security threats; or

  • misuse of our systems.

We will not terminate rights under an existing consumer transaction in a manner inconsistent with applicable Australian law.

39. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect:

  • legal or regulatory changes;

  • changes to our business;

  • new Website functionality;

  • security requirements; or

  • changes to our products or services.

The current version will be published on our Website with an updated revision date.

Changes will generally apply prospectively from the date they take effect.

We will not rely on a later change to unfairly remove rights that had already accrued under an existing transaction.

40. UNFAIR CONTRACT TERMS

These Terms are intended to operate consistently with the unfair contract terms provisions of the Australian Consumer Law.

Nothing in these Terms is intended to:

  • create a significant and unjustified imbalance between the parties;

  • allow us to avoid obligations that should reasonably apply to us;

  • impose disproportionate penalties on customers;

  • permit unilateral changes without appropriate justification; or

  • otherwise constitute an unfair term prohibited by Australian law.

If a provision is found to be unfair or unenforceable, it will be dealt with in accordance with applicable law.

41. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted, modified or severed to the extent permitted by law.

The remaining provisions will continue to operate where they are capable of doing so.

42. NO WAIVER

If we do not immediately enforce a right under these Terms, that does not necessarily mean we have waived that right.

Any waiver will operate only to the extent permitted by law.

43. ENTIRE AGREEMENT

These Terms, together with policies expressly incorporated into them, set out the terms governing your use of the Website and purchases from Yound bursh.

They should be read together with our:

  • Return & Refund Policy;

  • Shipping Policy;

  • Privacy Policy; and

  • other policies or conditions expressly presented during your purchase.

Nothing in this section excludes representations or rights that cannot lawfully be excluded.

44. GOVERNING LAW

These Terms are governed by the laws applicable in Australia and, where relevant, the laws of the Australian State or Territory that apply to the transaction.

Nothing in this section prevents a consumer from exercising rights to bring a claim in a court, tribunal or jurisdiction available to them under applicable Australian law.

45. DISPUTE RESOLUTION

If you have a concern or complaint about an order or our services, please contact us first so that we can attempt to resolve the matter.

Email: costumer@Youndbursh.store

We aim to handle complaints fairly and within a reasonable time.

Nothing in this section requires you to give up any right to contact a consumer protection regulator, fair trading agency, tribunal, court or other dispute resolution body available under Australian law.

47. CONSUMER LAW NOTICE

These Terms must be read subject to the Australian Consumer Law.

Where any provision of these Terms conflicts with a mandatory consumer right, guarantee or remedy under Australian law, the mandatory legal requirement prevails.

Your statutory consumer rights apply in addition to any rights expressly provided by Yound bursh.
